City nears agreement with former administrator

The New Fairview City Council moved closer to reaching terms on a separation agreement with former City Administrator Ben Nibarger.

The council agreed not to exceed $156,000 on the final pact Monday, which is being finalized by its city attorney. The agreement is expected to be finalized at the council’s next meeting, according to Mayor John Taylor.

The amount will be paid out of the city’s reserves. It is far less than the prorated portion left on Nibarger’s contract of $238,476.

Nibarger was hired in July 2020. In April 2021, the council approved a five-year contract for Nibarger. The agreement established pay levels of $105,000, $130,000 and $150,000 for the next three fiscal years.

In February, the council voted 3-2 to remove Nibarger without cause.

The council also approved Monday a oneyear contract for new City Administrator John Cabrales for $114,000. Cabrales was hired last month. He previously worked in Lake Dallas and Denton in administrative roles.

The council also accepted resignation of Steve Misner, who moved from the city. Misner is on the ballot to run for Place 3 on the council.
