San Marcos police shoot, kill ex-officer after he pulled a gun on them

Officers shot and killed a former San Marcos police officer at about midnight on Sunday at an apartment complex after he pulled a gun on the police.

Kyle Lobo, 36, reportedly had been drinking and holding a gun at The Grand at Stonecreek apartments, a female caller told a 911 operator, and the caller also claimed that Lobo had assaulted a resident, according to a press release from the San Marcos Police Department. Officers encountered Lobo outside of the apartment holding a child, the release stated, and Lobo eventually handed the child to the 911 caller.

Lobo then drew a handgun, and police shot him, the release said. First responders took Lobo to Ascension Seton Hays, where he was pronounced dead, police said.

The officers involved in the shooting have been placed on administrative leave, police said. The Texas Rangers and the San Marcos Police Department’s Criminal Investigations Division and the Office of Professional Conduct are investigating the shooting. The San Marcos Police Department did not immediately respond to requests for comment.

Last October, Hay's County Sheriff's Office arrested Lobo after he was accused of headbutting his wife and punching and kicking an 11-year-old child, according to an arrest warrant obtained by KSAT. Lobo resigned from the San Marcos Police Department and was given a dishonorable discharge the same day he was taken into custody, according to an October press release.
