Mother sues city of El Paso and water park for $1 million after toddler's drowning death

EL PASO, Texas (KFOX14/CBS4) — The mother of 3 year-old Anthony Leo Malave who drowned at an El Paso water park is taking legal action.

Court documents show the mother Jessica Weaver is suing the city, Destination El Paso and the company that runs the park ASM Global.

She is suing the three parties for a sum of $1 million.

The drowning happened on May 13 at Camp Cohen Water Park.

The little boy was pulled from the water and later died in the hospital.

The boy's mother and her lawyer claim the city was more concerned with filling the park for a soft opening than it was with the safety.

The lawsuit claims the city showed its lack of concern through a job posting seeking applicants 16 or older with experience not being a requirement.

The lawsuit also accuses the city of destroying surveillance video from the park on the day of the drowning.

KFOX14/CBS4 is reaching out to the city for comment.

The city officials have yet to talk to reporters about the drowning at this point, citing the incident is still "an active investigation."
