Killeen man indicted for allegedly trying to take officer’s weapon

A Killeen man tased for trying to take an Temple police officer’s weapon has been indicted by a Bell County grand jury.
Humberto E. Pacheco, 30, remained in the Bell County Jail on Friday, charged with attempt to take a weapon from an officer, a state jail felony, and four misdemeanors: public intoxication, evading arrest or detention, and resisting arrest. His bonds totaled $110,000, records show.
He was indicted by a grand jury on Sept. 27.
Pacheco was arrested July 20 after a Temple officer was dispatched at about 9:45 p.m. to the 2400 block of South 13th Street for a fight involving two intoxicated males. A woman told police one of the men touched her, according to an arrest affidavit.
“When the officer arrived, he located the caller and two males, who were clearly intoxicated and fighting,” Nohely Mackowiak, the city’s communications and public relations division director, previously told the Telegram. “The officer then saw one of the males go inside an apartment, and the other ran away from the officer even after the officer told him to stop. The officer caught up with the first male, identified as Arturo Elizondo, who had a strong alcohol smell emitting from his person. While the officer was placing Elizondo in handcuffs, the other male, Humberto Pacheco, exited the apartment with a knife.”
Pacheco eventually dropped the knife, and when the officer tried to detain Pacheco, he kept pulling away, and a struggle ensued.
“While the officer was struggling with Pacheco, Elizondo stood up and inserted himself into the situation,” Mackowiak said. “While the struggle was happening, the officer felt a strong tug on his belt. Pacheco tried to grab his taser, attempting to take it out of the holster.”
Mackowiak said the officer pulled away, and Elizondo stood up by the front door of the apartment, Pacheco then stood up and headed towards another door in the apartment.
“Fearing that Pacheco would get another weapon, the officer deployed his taser at Pacheco,” she said.
The officer held Pacheco at gunpoint while detaining the other man, the arrest affidavit said.
“Pacheco retreated to a bathroom in the apartment and was taken into custody by responding officers,” the affidavit said.
Pacheco is scheduled to appear before Judge John Gauntt in the 27th District Court for an arraignment hearing at 8:45 a.m. Oct. 19. A pretrial hearing is set for 8:45 a.m. Nov. 30, court records show.
